1. Acceptance of Terms

By accessing or using Filld's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

2. Description of Service

Filld provides automated appointment cancellation recovery services for dental practices. Our AI-powered system monitors your schedule, detects cancellations, and automatically contacts patients from your waitlist to fill open slots.

3. Account Registration

To use Filld, you must create an account and provide accurate, complete information. You are responsible for maintaining the security of your account credentials and for all activities under your account.

4. Subscription and Billing

  • Filld offers a 14-day free trial for new customers at no charge
  • After the trial period, subscriptions are billed monthly based on your selected plan
  • Annual plans are available at a discounted rate
  • You may cancel your subscription at any time; service continues until the end of the current billing period
  • If your trial converts to a paid subscription and you request cancellation within 48 hours of first charge, we will issue a full refund
  • No refunds are issued for partial billing periods after the 48-hour window

5. Your Responsibilities

You agree to:

  • Provide accurate patient and practice information
  • Obtain necessary consent from patients for SMS communications
  • Comply with all applicable healthcare regulations including HIPAA
  • Not use the service for any unlawful purpose
  • Maintain accurate waitlist and scheduling information

6. SMS Communications

Filld sends SMS messages to patients on behalf of healthcare practices for appointment scheduling, cancellation recovery, appointment reminders, and confirmation requests.

  • Program Name: Filld Appointment Notifications
  • Message Frequency: Message frequency varies. Patients may receive up to 5 messages per month related to appointment availability and scheduling.
  • Message and Data Rates: Message and data rates may apply. Contact your wireless carrier for details.
  • Opt-In: Patients opt in to receive SMS messages when their healthcare provider registers them in the Filld system. Patients receive an initial SMS disclosure message and must reply YES to consent to future appointment notifications.
  • Opt-Out: Patients may opt out at any time by replying STOP to any message. An opt-out confirmation will be sent. No further messages will be sent after opt-out.
  • Help: Reply HELP for assistance or contact info@filld.io.
  • Supported Carriers: Compatible with all major US wireless carriers.
  • Privacy: Patient phone numbers and personal information are not shared with third parties for marketing purposes. See our Privacy Policy for details.
  • Carrier Liability: Wireless carriers including T-Mobile are not liable for delayed or undelivered messages. As always, message and data rates may apply for any messages sent to you from us and to us from you.
  • Consent: SMS consent is voluntary and not required to receive dental care. Consent is specific to SMS appointment notifications and is separate from any other consents. You may opt out at any time without affecting your ability to receive care.

7. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any damages resulting from service interruptions, delays, or failures.

8. Limitation of Liability

Filld's liability is limited to the amount you paid for the service in the 12 months preceding any claim. We are not liable for indirect, incidental, special, or consequential damages, including lost revenue or profits.

9. Intellectual Property

Filld and its logo, features, and functionality are owned by Filld and protected by copyright, trademark, and other intellectual property laws.

10. Termination

Either party may terminate this agreement at any time. Upon termination, your access to the service will be disabled, and we will delete your data in accordance with our Privacy Policy.

11. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.

12. Dispute Resolution

Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in New York, New York. Each party shall bear its own costs and attorney fees. Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction.

13. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance.
